PART I — COPYRIGHT & INTELLECTUAL PROPERTY
Hopsquirrel Platform — User Content Agreement
1. Original Authorship. All content you upload is entirely your own original work. No portion derives from third-party copyrighted material without prior written clearance from the rights holder.
2. IP Rights. You own all intellectual property rights in your content or hold a valid written license to publish on a public digital platform.
3. AI Content Disclosure. AI-assisted works must not reproduce copyrighted training data substantially. You must affirmatively disclose AI involvement in the content description. Failure constitutes material misrepresentation.
4. Indemnification. You accept full sole personal legal responsibility for all submitted content and agree to indemnify, defend, and hold harmless Hopsquirrel against all claims, liabilities, damages, losses, and costs.
5. DMCA Compliance. Hopsquirrel complies with 17 U.S.C. § 512. Verified notices result in immediate removal and possible account termination. Repeat infringers are permanently banned.
6. Statutory Liability. Willful infringement may expose you to statutory damages up to $150,000 per work under 17 U.S.C. § 504(c)(2).
PART II — PROHIBITION ON SEXUALLY EXPLICIT & ADULT CONTENT
⚠ ABSOLUTE ZERO-TOLERANCE POLICY — NO EXCEPTIONS
Binding, unconditional prohibition on sexually explicit, obscene, lewd, or pornographic content of any kind — all content types, all submission methods, without exception.
7. Prohibition. You will NOT upload content that: (a) depicts or implies sexual acts in any form; (b) contains nudity in a sexual context; (c) constitutes obscenity under
Miller v. California, 413 U.S. 15 (1973); (d) is harmful to minors under 18 U.S.C. §§ 1460–1466A; (e) constitutes non-consensual intimate imagery; (f) is consistent with commercial adult entertainment; (g) was AI-generated to produce sexual content — AI origin provides no exemption whatsoever.
🚩 CSAM — FEDERAL LAW APPLIES
Content depicting or simulating a minor in a sexual context is a federal crime under 18 U.S.C. § 2256 and § 1466A. This applies equally to real, illustrated, and AI-generated depictions. Hopsquirrel will report ALL suspected CSAM to the NCMEC CyberTipline and federal law enforcement immediately. Account data, IP records, and metadata will be preserved and disclosed to authorities upon lawful request.
8. Consequences of Violation: (i) immediate permanent content removal; (ii) account termination; (iii) referral to law enforcement; (iv) full account data disclosure as required by law. Hopsquirrel reserves all civil remedies.
PART III — COMMUNITY STANDARDS & GENERAL CONDUCT
9. Prohibited Content. No graphic violence or gore; no hate speech; no harassment, threats, or doxxing; no terrorism promotion; no malware; no illegal activity facilitation.
10. Age Requirement. You must be at least 18 years of age. Persons under 18 are not authorized to use this platform.
11. Platform Rights. Hopsquirrel may remove content, suspend or terminate accounts, and refer users to law enforcement at sole discretion without prior notice.
12. Governing Law. This Agreement is governed by United States federal and applicable state law.
